Contract

You agree that by accessing, using or registering an account with our Services (defined below), you are agreeing to enter into a legally binding contract with Productability USA, LP. (“Productability”) by which you agree to abide by the terms set forth below in this contract and privacy policy (“Contract”). You are bound by this Contract even if you are using our Services on behalf of a company or other person.

From time to time, we may modify this Contract and our Privacy Policy (set forth below and incorporated into the Contract). If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before the date by which they become effective as indicated in the notice (the “Effective Date”). Your continued use of our Services after we publish or send notice about changes to the Contract means that you are consenting to the updated Contract as of the Effective Date.

If you wish to terminate this Contract at any time, you can do so by emailing us at [email protected] and thereafter no longer accessing or using our Services or Materials (as defined below).

Services

This Contract applies to Productability.com, other Productability-related websites, applications, communications, programs and other services that Productability identifies as offered under this Contract (“Services”), including the offsite collection of data for those Services. Anyone who uses, accesses, registers an account with, or otherwise agrees to be bound by this Contract, is referred to herein as a “User.”

Material

We respect the intellectual property of others, so we ask you to do the same. The source code, video, text, software, photos, graphics, images, audio, designs, trademarks, proprietary information and other content of the Services (collectively, “Materials”) are protected by copyright, trademark and other laws. Productability and applicable third parties, such as Productability’s licensors, own copyright, trademark, and other rights in the Services and Materials, and reserve all rights in them.

Eligibility to Use or Access Services and Materials

From time to time Productability may make available, and you may view, certain Materials on Productability.com without registering to use our Services, but as a condition of viewing and using certain portions of the Services and Materials, you are required to register an account with Productability. You shall provide accurate, complete, and up-to-date registration information. Failure to do so shall constitute a breach of the Contract, which may result in immediate termination of your account.

You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password. You shall not use another User’s account without that other User’s express permission. You will immediately notify us in writing through an email to [email protected] of any unauthorized use of your account, or any other known account-related security breach.

Productability reserves the right to restrict, suspend or terminate your use of the Services if you breach this Contract or the law, or if Productability determines in its discretion that you are misusing the Services in any way. In all cases Productability reserves the right to restrict, suspend or terminate your use of Services at its sole discretion and at any time and the creation of an account or registration of information does not constitute a right or guarantee that the Services will be made available to you.

Use of Services and Materials

You may use the Services and Materials only in the manner and for the purposes specified in this Contract.

Except as provided in this Contract, you may not access, use, download, modify, publish, transmit, participate in the transfer or sale of, reproduce, create new or derivative works from, distribute, perform, display (including framing and inline linking), communicate to the public or in any way exploit, any of the Services and Materials in whole or in part.

You may download and copy Materials clearly designated as a “downloadable” within the Services and you may take notes summarizing the Materials within the Services, in each case solely for your personal use. If you wish to use other Materials in other ways including but not limited to within your organization, you may do so only if you request and receive specific prior written authorization from Productability.

You may use and access the Services only through platforms authorized by Productability, such as the Productability.com website and Notion, and only in a manner that comports with the User Conduct Policies and other terms set forth in this Contract.

User Conduct Policies

Your eligibility to use or access the Services and Materials is contingent on remaining in good standing as a member of the Productability community. These policies, which we continue to develop, provide guidance and rules for the use of our Services and Materials:

  • Do not violate Productability’s rights in its intellectual property or proprietary information, including by suggesting that you are affiliated with, authorized by or approved by Productability when you are not.
  • Do not use the Services or Materials to compete with Productability, or to solicit Productability’s Users or potential customers for commercial purposes.
  • Do not publicly communicate information about another User obtained through the Services.
  • Do not communicate false, disparaging or defamatory information about another User of the Services.
  • Do not use the Services to abuse, harass, intimidate or shock another User.
  • Do not use the Services to share graphic, obscene, or pornographic content.
  • Do not use robotic automation to access the Services or to collect Materials.
  • Do not use the Services for illegal activities, promotion of illegal products or activities, or violation of the rights of others.
  • Do not use the Services to intentionally distribute viruses, worms, or other software that can destroy or interrupt others’ data or computer systems or devices.
  • Do not interfere with or disrupt the Services.

Any violation of these policies shall constitute a breach of the Contract, which may result in immediate termination of your account.

Notices and Communications

We will provide notices and communications to you in the following ways: (1) through the Services, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Privacy Policy

The Productability Privacy Policy helps you to understand how we collect and use the personal information you provide to us and to assist you in making informed decisions when using our site and our products and services.

What Information Do We Collect?

When you visit our website you may provide us with different types of information such as: information about yourself that you knowingly choose to disclose that is collected on an individual basis, website use information, and email engagement information.

1. PERSONAL INFORMATION YOU CHOOSE TO PROVIDE

You will provide us your name, email address, and LinkedIn account when you apply or sign up for a Productability program.

2. WEBSITE USE AND EMAIL ENGAGEMENT INFORMATION

Similar to other commercial websites, this site utilizes a standard technology called “cookies” and Web server logs to collect information about how this site is used. Information gathered through cookies and web server logs may include the date and time of visits, IP address, the pages viewed, time spent at this site, and the websites visited just before and just after our site. We, our advertisers and ad serving companies may also use small technology or pieces of code to determine which advertisements and promotions users have seen and how users responded to them.

We also track email engagement data including which emails you open and which links you click on.

3. OTHER INFORMATION

In addition, we may collect other information. This includes non-digital engagement data such as which events you attend; company information such as your company name, size, and industry. We may also obtain data from third party data providers with information that includes your job title, location, gender, links to your social media profile, and company information.

How Do We Use the Information That You Provide to Us?

We never sell your information to anyone.

Broadly speaking, we use personal information for purposes of administering and expanding our business activities, providing customer service, and making available other products and services to our customers and prospective customers.

Examples of how we use this information include: suggesting the most relevant program and content for you based on your experiences and profile; personalizing communications; changing the frequency of communications based on your profile and preferences.

Sharing Information with Third Parties

The information we collect is used to improve the content of this site and the quality of our service and, except as explicitly stated below, is not shared with or sold to other organizations for commercial purposes. That being said, your information could be shared under the following circumstances:

We use third parties to facilitate our business, including, but not limited to, sending email, processing payments, processing customer support requests, marketing and managing our website. In connection with these offerings and business operations, these third parties may have access to your personal information for use in connection with those business activities. Third parties include, but are not limited to, Autopilot, Trello, Zapier, Stripe, Google, Sendinblue, Notion, Typeform, and other services such as we may engage with from time to time.

If it becomes necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Contract, or as otherwise required by law.

We may disclose your personal information if required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law or comply with legal process served on us or affiliated parties; (b) protect and defend our rights and property, our site, the users of our site, and/or our affiliated parties; (c) act under circumstances to protect the safety of users of our site, us, or third parties.

For users of our career coaching, role-finding, or interview coaching services we may share information with select third parties who may perform some or all of those services. As such users of this service should expect us to share their details with select third parties both for the purposes of executing the services and also for commercial purposes.

In all cases users shall indemnify and hold harmless Productability, any introduced third parties, and their respective officers, employees, consultants, agents and representatives (the "Indemnified Parties") against any and all Claims which may be asserted against or suffered, which relate to any death, injury or loss or damage to property suffered by the user, to the extent resulting from any negligent act or omission of the Indemnifying Party and its respective officers, employees, consultants, agents and representatives.

How Do We Secure Information Transmissions?

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email. Some of the information you may enter on this site may be transmitted securely via Secure Sockets Layer SSL, 128 bit encryption services. Pages utilizing this technology will have URLs that start with HTTPS instead of HTTP.

What About Other Websites Linked to This Site?

We are not responsible for the practices employed by websites linked to or from our site nor the information or content contained therein. Often links to other websites are provided solely as pointers to information on topics that may be useful to the users of our site. Please remember that when you use a link to go from our site to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including sites which have a link on our site, is subject to that website’s own rules and policies. Please read over those rules and policies before proceeding.

Your Consent

By using this site, applying or signing up for a program, you consent to our collection and use of your personal information as described in this Privacy Policy. If we change our privacy policies and procedures, we will notify you of the changes pursuant to the notice procedure set forth in the Contract.

How Can You Withdraw or Refuse Consent?

You can withdraw or refuse consent at any time without detriment in the following ways: You may unsubscribe from our emails at any time by clicking the “unsubscribe” button at the bottom of the email. By unsubscribing, you will no longer receive ANY emails from Productability. If you would like to access the data we have stored about you, you can do so by emailing [email protected]. If you would like us to erase your personal data, you can do so by emailing [email protected]. Our website does not provide Do Not Track requests at this time, which means our third party analytics providers may associate your usage on Productability with your usage on other sites.
